ARMSTRONG RECRUITMENT LTD. TERMS AND CONDITIONS OF BUSINESS TEMPORARY STAFF

THESE CONDITIONS APPLY TO ANY CONTRACT BETWEEN US FOR THE SUPPLY OF A TEMPORARY WORKER OR WORKERS.

  1. We have agreed to provide you with one or more temporary workers upon the conditions set out herein.
  2. The client agrees to pay the Company the charges as agreed prior to the services of the Temporary Worker being supplied. The client agrees to pay a minimum of 8hrs per           assignment. We shall give at least two weeks notice of any change in our scale of charges. We reserve the right where genuine doubts arise as to your financial position or in a case of failure to pay for any services to suspend performance of any service without liability until payment or satisfactory security for payment has been provided.
  3. You shall be invoiced for our fees weekly which are payable by you within 30 days from invoice date. These are payable to Royal Bank Invoice Finance. We reserve the right to   charge interest at the rate of 4% over the base lending rate of the Royal Bank of Scotland for payments not paid within 30 days.
  4. We shall make every effort to ensure reasonable standards of skill, care, integrity and reliability from our temporary workers. We shall have no responsibility or liability whatsoever for any loss of profit, business, contracts or any special, consequential or indirect loss incurred or suffered by you arising directly or indirectly out of this contract or the performance of the temporary worker. Although we shall use all reasonable endeavors to ensure that performance of the services is carried out at the stated time, no delay shall entitle you to reject any performance or any further installment or to repudiate the contract.
  5. We reserve the right to charge you a cancellation fee at the rate in force at the time of the cancellation if you give less than 24 (twenty four) hours notice of your desire to cancel an assignment for which one of our temporary workers has already been placed.
  6. If you wish to terminate an assignment before the end of the agreed assignment period for which our employee was placed then you must give 24 (twenty four) hours notice of termination of the assignment. We reserve the right to charge for the temporary workers agreed assignment time if less than 24 (twenty-four) hours notice is given.
  7. You undertake to supervise the temporary worker during the period of the assignment with you so as to ensure your own satisfaction with the standard of work provided by the temporary worker. If you are not satisfied with the standard of work performed by the temporary worker then this should be notified to Armstrong Recruitment Ltd immediately and if appropriate the temporary worker will be asked to terminate his/her assignment. We should be notified within four hours of the commencement of the assignment, if the standard of work performed by the temporary worker is unsatisfactory, or as soon afterwards as is practically possible. We shall then endeavor to replace the temporary worker for you. You will however be responsible for paying our charges for the temporary worker concerned.
  8. All temporary workers are employed by Armstrong Recruitment Ltd. If you offer a contract of employment to any of our workers which is accepted by that worker within six months of the temporary worker being involved in an assignment for your Company or any other Company legally connected to your company, then a fee equal to twelve weeks pay at the rate charged by Armstrong Recruitment Ltd for that temporary worker shall immediately be payable to us and all our rights and obligations to the temporary worker shall cease and determine upon commencement of his employment with you. .
  9. These Terms and Conditions of business constitute all the terms and conditions between Armstrong Recruitment Ltd and yourself. These Terms and Conditions are accepted by you as soon as a temporary worker is supplied. No variation of the terms and conditions shall be binding unless agreed by both Armstrong Recruitment Ltd and you in writing.

 

Permanent Assignments Terms

ARMSTRONG RECRUITMENT LIMITED. TERMS OF BUSINESS PERMANENT ASSIGNMENTS

1. Initial request

Following the initial request for a permanent employee Armstrong Recruitment Ltd will require a full job specification including hours to be worked, duties to be performed, computer packages used (if relevant), experience and age range required, salary and start date. Armstrong Recruitment will visit the client to discuss the position in further detail. All assignments are taken on the understanding that no other recruitment shall be carried out from anyone outside Armstrong Recruitment Services.

2. Selection Process

A short list of at least 3 candidates (dependent on client's requirements) will be issued to the client who will then be responsible for final selection. References will be taken up by Armstrong Recruitment Ltd who will also arrange interviews for the client with the candidates. The client will be responsible for notifying both the successful candidate and Armstrong Recruitment Ltd.

3. Appointment Fee

An appointment fee will be payable to Armstrong Recruitment Ltd on acceptance by a candidate of permanent employment by the client. This includes positions other than those notified. An appointment fee of 10% of the annual salary per employee is payable upon invoice. An initial fee of £75.00 (plus VAT) will be payable on agreement by Armstrong Recruitment Ltd to undertake the assignment. This will be deducted from the final invoice this will also be refunded if none of the interviewed candidates are suitable for the position. However, there will be no refund if the client interviews no applicants.

4. Change of specification

Should a client change any of the initial specifications in respect of a recruitment assignment. Armstrong Recruitment Ltd will invoice the client for any advertising costs already incurred.

5. Cancellation or Deferment

Should a client cancel or defer a recruitment assignment. Armstrong Recruitment Ltd will be entitled to any reasonable costs accrued at the time of cancellation or deferment.

6. Copyright on Advertising

Armstrong Recruitment Ltd retain copyright on all advertising and other written or pictorial material produced by them, and such material may not be reproduced, all or in part without their written permission.

7. Advertising

Armstrong Recruitment Ltd will advertise the position locally if necessary. Should the client wish the position to have specialist advertising e.g. Radio, Internet, National, International etc Armstrong Recruitment Services Ltd will be pleased to offer advice and costing as required.

8. Guarantee

Should a candidate appointed through Armstrong Recruitment Ltd voluntarily leave the client company or group within four weeks of commencing work, the guarantee is as follows:

a) Armstrong Recruitment Ltd will provide a replacement candidate, with no further fee (excluding agreed re advertising costs) and a candidate details will be forwarded to the company within 2 weeks of being asked to proceed. b) Should Armstrong Recruitment Ltd fail to provide an acceptable replacement candidate as per 8a above, Armstrong Recruitment Ltd will refund 20% of the recruitment fee ( excluding any chargeable advertising costs) c) Should the client decide not to proceed with recruiting a replacement candidate, the fee refund as per 8b above will not be put in effect d) The guarantee described above is subject to Armstrong Recruitment Ltds payment terms having been met.

9. Payment Terms

a) All invoices are due for settlement on receipt of invoice. Armstrong Recruitment Ltd reserve the right (which may be exercised at anytime) to charge interest at 4% over the Royal bank of Scotland current base lending rate on invoices outstanding for more than 30 days from invoice date. b) VAT (at the current rate on invoice date) will be added.

I hereby confirm that I have received a copy of Terms of Business and agree to abide by the conditions stated therein and understand that when an employee is recruited through the agency the commission fee will be as stated under 'appointment fee'.
